STONE BY STONE GUEST TERMS & CONDITIONS
For Appearances on the “Stone by Stone” Podcast
Agreement Overview
This Guest Agreement (“Agreement”) is entered into by and between Edgewater Castle FC, a nonprofit organization based in Chicago, Illinois (“Producer”), and the undersigned individual (“Guest”) in connection with the Guest’s appearance on the podcast titled “Stone by Stone” (“Podcast”). By participating in the Podcast, the Guest agrees to the terms set forth below.
Recording and Participation
The Guest acknowledges and agrees that their Podcast episode will be recorded in both audio and video formats. The Producer retains full discretion over the editing of the recorded materials prior to their public release. Guests may request the removal or redaction of sensitive information that they unintentionally disclosed during the recording, if the publication of such information would reasonably be expected to cause harm. The Producer will evaluate these requests in good faith but is not obligated to make any edits beyond what is deemed reasonable under the circumstances.
Rights and Ownership
All rights to the audio and video recordings, including all intellectual property and derivative works arising from the Guest’s appearance, are owned exclusively by Edgewater Castle FC, along with any individuals or entities formally designated as a Producer or as the Recorded At location. The Guest is granted a non-exclusive, royalty-free license to use clips from their episode for personal or professional promotional purposes, provided that such clips remain unaltered from their original, published form.
Use of Likeness
The Guest grants the Producer the irrevocable right to use their name, voice, image, and likeness in connection with the Podcast and any related promotional or marketing materials. This usage will be limited to the promotion and distribution of the Podcast on platforms including, but not limited to, Spotify, YouTube, and edgewatercastlefc.com. The Producer agrees not to alter the Guest’s likeness in any way that would misrepresent or depict them in a disingenuous manner.
Monetization and Sponsorship
The Guest understands and agrees that the Podcast may contain third-party advertisements or sponsorship content, whether at the time of their episode’s release or in the future. Participation in the Podcast does not entitle the Guest to any form of compensation or revenue share. The Guest’s likeness may appear adjacent to sponsor content but will not be used to directly endorse any third-party entity without the Guest’s additional written consent.
Guest Conduct and Content Limits
The Guest agrees not to engage in speech or behavior during the recording that would violate the Terms of Service or Community Guidelines of platforms such as YouTube or Spotify, or any applicable FCC regulations. Prior to the recording session, the Producer will offer the Guest an opportunity to share any personal discussion boundaries or topics they wish to avoid. While the Producer will make a good-faith effort to respect those boundaries, they reserve the right to include any and all recorded content at their discretion.
Confidentiality and Sensitive Information
Any information that the Guest wishes to designate as confidential must be clearly identified as such either immediately before, during, or directly after the relevant portion of the conversation. In exceptional cases, a delayed notification may be accepted if the content in question would reasonably be expected to cause significant harm if released. The Producer will consider such requests on a case-by-case basis but is not automatically obligated to act upon them.
Data Collection and Use
The Producer may collect limited information from the Guest—including but not limited to their name, biography, contact information, headshot, and social media handles—for the purposes of communication, episode framing, and promotional efforts related to the Podcast. This information will be used solely in connection with the Guest’s appearance and the general promotion of the Podcast and will not be sold or used for unrelated marketing purposes.
Legal Waivers and Representation
The Guest acknowledges that their participation is entirely voluntary and that no compensation is owed unless otherwise agreed to in writing. The Guest waives any claims against the Producer for defamation, misrepresentation, or infringement, except in cases where a reasonable person would conclude that the content constitutes a serious and intentional misrepresentation. The Guest affirms that they have the legal right to enter into this Agreement and that their appearance does not violate any existing contractual or legal obligations.
Jurisdiction and Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois. Any disputes or legal actions arising from this Agreement shall be brought exclusively in the courts located in Cook County, Illinois.
Entire Agreement and Modifications
This document represents the full and complete agreement between the Guest and the Producer concerning the Guest’s appearance on the Podcast. It supersedes any prior verbal or written communications on the subject. Any modifications must be made in writing and agreed to by both parties.
